Terms of Service

These Terms of Service (“Terms”) are a binding agreement that governs your access to and use of Visa Engine, a software product operated by Case Studio, Inc.(“Case Studio,” “we,” “us,” or “our”), a Delaware corporation. They are written for a real product but are not a substitute for counsel review of your own arrangements. Please read them carefully—they include disclaimers of warranties, a limitation of liability, an indemnity, and, in section 19, an agreement to resolve disputes by binding arbitration on an individual basis and a waiver of class actions and jury trials, subject to your right to opt out. We may update these Terms; the date above reflects the latest version.

1. Acceptance of these Terms

By creating an account, accessing, or using Visa Engine, you agree to these Terms and our Privacy Policy. If you use the Service on behalf of a firm or other organization, you represent that you have authority to bind that organization, and “you” includes that organization. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use Visa Engine. You represent that you are not barred from using the Service under the laws of any applicable jurisdiction and that your use complies with all laws that apply to you.

3. Description of the Service

Visa Engine is an AI-powered petition workspace for talent and criteria-based visas. Features may include document upload and versioning, evidence analysis against visa criteria, readiness scoring, case preparation questionnaires, chat, draft generation, RFE-related workflows, firm collaboration features, and related tools across supported jurisdictions and visa types.

Case Studio may also offer petition preparation or related professional services. Those services are separate from the Visa Engine software subscription. A services engagement is governed by its own contract, statement of work, or engagement letter—not by these software Terms—unless we expressly say otherwise in writing.

We may modify, suspend, or discontinue features as we improve the product. We do not guarantee that any particular feature will remain available indefinitely.

4. Not a law firm; not legal advice; unauthorized practice of law

Visa Engine is not a law firm. Case Studio is not a law firm. Neither Visa Engine nor Case Studio provides legal advice, legal opinions, or representation through the software. Outputs from the product—including analyses, scores, gap lists, drafts, chat answers, and suggestions—are informational and assistive only.

An attorney (or other authorized legal practitioner, where applicable) remains the legal actor responsible for advising the client, exercising professional judgment, and filing with immigration authorities. You must not treat Visa Engine as a substitute for licensed counsel. Nothing in the product or these Terms creates an attorney–client relationship with Case Studio.

You agree not to use Visa Engine in a way that constitutes the unauthorized practice of law in any jurisdiction. If you are a non-lawyer assisting with a case, you remain responsible for complying with applicable rules on UPL, supervision, and client communication.

5. AI features, limitations, and acceptable AI use

Visa Engine uses artificial intelligence, including third-party large language models, to assist with analysis, extraction, scoring, drafting, and chat. AI systems can be wrong, incomplete, outdated, or misleading, and can produce confident but inaccurate or fabricated content (“hallucinations”). Readiness scores, criterion evaluations, extracted facts, drafts, chat answers, and similar outputs may omit critical issues or invent details.

Mandatory human review.You —and any attorney responsible for the matter—must independently review, verify, and edit all AI outputs before relying on them, sharing them, or including them in any petition, evidence package, letter, or filing. You must not use Visa Engine as the sole basis for any decision that has legal or similarly significant effects on any person, and you must keep a qualified human in the loop for such decisions.

Acceptable AI use.You agree not to use the AI features to (a) generate content that is unlawful, fraudulent, defamatory, or that infringes others' rights; (b) submit false, fabricated, or misleading information to any government authority; (c) attempt to reverse engineer, extract, or replicate the underlying models, prompts, weights, or training data; (d) build a competing model or dataset from the outputs; or (e) circumvent safety, rate, or usage limits. When you use AI features, you must also comply with the acceptable-use and usage policies of our AI providers (for example, OpenAI), which apply to content you submit and generate.

You remain solely responsible for the accuracy, completeness, and legality of anything prepared with assistance from Visa Engine.

6. Accounts and acceptable use

You must provide accurate account information and keep credentials secure. You are responsible for activity under your account. Notify us promptly of unauthorized access.

You agree not to:

  • Upload content you do not have the right to share, or materials obtained unlawfully;
  • Use the Service to harass, defraud, or violate others' rights;
  • Attempt to probe, disrupt, or bypass security, rate limits, or usage limits;
  • Reverse engineer, scrape, or systematically extract the product, models, or knowledge base except as allowed by law;
  • Resell, sublicense, or provide the Service to third parties as a competing hosted offering without our written permission;
  • Upload malware or content that is illegal, or use the Service for any unlawful purpose.

We may suspend or terminate access for violations or to protect the Service and other users.

7. Subscriptions and billing

Visa Engine offers a Free tier and paid subscription tiers (currently Starter and Pro) with different usage limits (for example cases, documents, drafts, and chat). Paid plans are billed through Stripe. Prices, features, and limits are described on our pricing page and may change; changes to paid plans generally apply on renewal or as otherwise disclosed at checkout or in-product.

Unless otherwise stated at purchase, subscriptions renew automatically until you cancel. You can cancel anytime via the Stripe customer portal or in-product billing management where available; cancellation typically takes effect at the end of the current billing period. Fees already paid are generally non-refundable except where required by law or expressly stated by us. You are responsible for any taxes associated with your subscription.

Firm or organization features may be available in pilot or early access. Unless we publish a separate firm pricing plan and you subscribe to it, firm use may be billed under the account owner's consumer subscription tier. We do not invent or guarantee specific firm seat SKUs in these Terms; any firm commercial terms will be disclosed separately when offered.

8. Beta and early-access features

We may offer features labeled beta, preview, pilot, or early access. These are provided “as is” for evaluation, may be changed or withdrawn at any time, may be less reliable, and are excluded from any service commitments. Your use of such features is at your own risk.

9. User content and documents

You retain ownership of the documents, text, and other materials you upload or enter (“User Content”). You grant Case Studio a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and create derivative works from User Content solely as needed to provide, secure, and improve Visa Engine—including sending content to subprocessors such as AI providers for analysis and drafting. We do not use your User Content to train our own AI models.

You represent and warrant that you have all rights necessary to upload User Content and to grant this license, that you have a lawful basis to process any personal information of third parties (such as clients or applicants) contained in it, and that doing so does not violate confidentiality, privacy, export, intellectual property, or other laws. 10. Intellectual property

Visa Engine—including software, UI, branding, documentation, visa guide content we publish, and underlying systems—is owned by Case Studio or its licensors. These Terms do not transfer ownership of our IP to you. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business or personal petition-preparation purposes while your account is in good standing.

As between you and Case Studio, and to the extent permitted by law, you own the outputs generated specifically for you from your inputs (“Outputs”), subject to your compliance with these Terms and the terms of our AI providers. Because AI can generate similar responses for different users, Outputs are not unique to you and we may generate comparable content for others. Feedback you provide may be used by us without obligation to you.

11. Third-party services and copyright complaints

The Service depends on third-party providers (including Supabase, Google, OpenAI, Vercel, and Stripe) and may link to third-party sites. Your use of those services is governed by their own terms, and we are not responsible for third-party services or content. If you believe content on the Service infringes your copyright, contact us at akif@casefuture.com with enough detail to identify the work and the allegedly infringing material, and we will respond as required by applicable law.

12. AI output disclaimer

AI systems can be wrong, incomplete, outdated, or misleading. Readiness scores, criterion evaluations, extracted facts, drafts, chat answers, and similar outputs may omit critical issues or invent details. You—and any attorney responsible for the matter— must review all outputs before relying on them or including them in a filing. You remain solely responsible for the accuracy, completeness, and legality of any petition, evidence package, letter, or filing prepared with assistance from Visa Engine.

13. No guarantee of immigration outcomes

Immigration decisions are made solely by government authorities. Case Studio does not guarantee visa approval, petition approval, interview outcomes, processing times, or any particular immigration result. Use of Visa Engine does not increase the likelihood of approval by itself and does not create any warranty regarding eligibility.

14. Assumption of risk

Immigration matters are high-stakes and time-sensitive. You knowingly assume the risks of relying on software assistance, including the risk of AI error, and you are responsible for meeting deadlines and for the final review of any materials before submission. You should keep independent copies of important documents.

15. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISA ENGINE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT AI OUTPUTS WILL BE ACCURATE, COMPLETE, OR FIT FOR FILING. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASE STUDIO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, OR ANY DAMAGES ARISING FROM IMMIGRATION DENIALS, DELAYS, OR FILING DECISIONS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO CASE STUDIO FOR VISA ENGINE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in those cases, our liability is limited to the fullest extent permitted by law. These limitations are a fundamental basis of the bargain between you and Case Studio.

17. Indemnity

You agree to defend, indemnify, and hold harmless Case Studio and its officers, directors, employees, and agents from and against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your User Content; (b) your use of Visa Engine; (c) your violation of these Terms or applicable law; (d) your infringement of any third party's rights; or (e) any dispute between you and a client, applicant, or third party regarding a petition or immigration matter.

18. Term and termination

You may stop using Visa Engine at any time and may request account deletion as described in the Privacy Policy. We may suspend or terminate access immediately if you breach these Terms, if required by law, or if we discontinue the Service. Upon termination, your license to use the Service ends. Provisions that by their nature should survive (including ownership, disclaimers, limitations, indemnity, dispute resolution, and governing law) will survive.

19. Dispute resolution; arbitration; class-action waiver

Please read this section carefully—it affects how disputes are resolved. Before filing any claim, you agree to first contact us at akif@casefuture.com and try in good faith to resolve the dispute informally for at least 30 days.

If we cannot resolve it, you and Case Studio agree that any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration, rather than in court, except that either party may bring qualifying claims in small-claims court and may seek injunctive relief in court for intellectual-property or unauthorized-access matters. The arbitration will be conducted by a recognized arbitration provider under its applicable rules.

Class-action and jury-trial waiver. To the extent permitted by law, disputes will be conducted only on an individual basis and not as a plaintiff or class member in any class, consolidated, or representative proceeding, and you and Case Studio waive any right to a jury trial.

Opt-out. You may opt out of this arbitration and class-waiver agreement by emailing us at akif@casefuture.com within 30 days of first accepting these Terms. This section does not apply where prohibited by law, and mandatory consumer-protection rights in your place of residence are unaffected.

20. Governing law

Case Studio, Inc. is a Delaware corporation. These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your place of residence require otherwise. Subject to section 19, courts located in Delaware will have exclusive jurisdiction over disputes arising from these Terms, subject to those mandatory protections.

21. Export controls and sanctions

You must comply with all applicable export control and economic sanctions laws. You represent that you are not located in, and will not use the Service from, a country or region subject to comprehensive sanctions, and that you are not on any restricted-party or denied- person list. You agree not to use the Service for any purpose prohibited by such laws.

22. Force majeure

We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, labor disputes, internet or utility failures, or failures or degradations of third-party providers.

23. Changes to these Terms

We may update these Terms as the product or legal requirements change. When we do, we will revise the effective date above and, for material changes, provide reasonable notice in-product or by email where appropriate. Your continued use of Visa Engine after an update means you accept the revised Terms.

24. General

These Terms, together with the Privacy Policy and any order or checkout terms for a paid plan, are the entire agreement between you and Case Studio regarding the Visa Engine software. If any provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. There are no third-party beneficiaries.
